TERMS & Conditions
By doing business with Battitude LLC [DBA, Battitude Studio], you (the client / commissioner / customer) hereby agree to our terms & conditions:

Age Limitation Clause:
-
Adults only. You must be 18 years of age or older to request, purchase or receive any product or service from Battitude LLC [DBA, Battitude Studio].

Age Verification. We may require age verification at any time (for example: confirming date of birth, requiring a government ID with non-essential info redacted). If you refuse or cannot verify age, we reserve the right to cancel the order.

If you are under 18. Do not place an order. If we discover you are under 18 after payment, we will cancel the commission. Refunds, if any, are handled under our Refunds section and may exclude non-recoverable fees/costs where permitted by California law.

Commission Limitations; Right of Refusal. Battitude LLC reserves the right to refuse, cancel, or decline any commission request at our sole discretion. We do not accept commissions that involve:

Crafting fursuits in another artist's style,
-
Changing our style for your project ie; different styled eyes,
-
Craft costumes of characters that are licensed by a company (For Example: Pokemon, Digimon, Disney, etc.).
-
Hate Symbols, extremist content, or harassment/targeted intimidation;
-
Illegal content or requests intended to facilitate illegal activity; or
-
Any request that violates third-party intellectual property rights or platform/payment processor rules.

Quotes, Scope, and Custom Nature of Work
-
Custom-made item. Each fursuit is made to order. Because it is customized, colors/materials may vary slightly due to dye lots, fur direction, lighting and availability.

Scope of work. Your quote/invoice describes what is included (examples: head, paws, feet, tail, bodysuit, accessories, etc.). Anything not listed is not included.

Design clarity. You are responsible for providing clear references at the beginning of the order (ref sheets, color palettes, markings, character notes). Ambiguous or missing references can cause delays and/or extra fees.

Production Timeline, Due Dates, and Delays
-
Estimated timelines only. Any timeline or “due date” we provide is an estimate, not a guarantee, unless we, Battitude LLC [DBA, Battitude Studio], explicitly agree in writing that a deadline is guaranteed.

What affects timing. Timing depends on supply chain, complexity, your responsiveness, revision requests, health/emergencies, and queue volume.
-
Client-caused delays. If we’re waiting on your measurements, references, approvals, or responses, the timeline shifts accordingly.
-
Rush orders (Optional). Rush service may be available for an additional fee, based on schedule. Rush agreements must be in writing and may require full upfront payment.

Payment Terms (Deposits, Milestones, Late Payments)
-
Payment schedule. Payment shall be made in full within 30 days upon receipt of the invoice.
-
Deposits. Deposits cover reservation of time, planning, and initial procurement. Deposits are non-refundable except where required by law or if we cancel the commission (see Refunds)
-
No work starts until paid. Work begins only after the full payment has cleared.
-
Late payments. Invoices not paid within 30 days will forfeit their commission order.
-
Processing fees. Payment processor fees (Paypal, Stripe, etc.) are non-refundable and may be deducted from refunds where permitted.
-
Chargebacks/disputes. Filing a chargeback without first contacting Battitude LLC to resolve the issue is a breach of these Terms. We will provide documentation (messages, photos, invoices, policy) to contest chargebacks.

Client Responsibilities (What we expect from YOU)

You agree to;
-
Provide accurate measurements by our requested method and by the deadline we set.
-
We will request a DTD (Duct Tape Dummy) that is durable.
-
We expect the DTD to be shipped within 30 days on the date of receipt of invoice.

Workflow and Approvals (How the Project Runs)
-
Stages. We work in the following order:
-
Material confirmation,
-
Material purchase,
-
Sculpting,
-
Patterning,
-
Sewing,
-
Part Builds,
-
Detailing,
-
Finishing,
-
Final Photos, and
-
Shipping
-
-
Progress updates. We provide frequent updates as milestones on the project.

Approvals. We may request approval at key stages. Approval means you accept that stage and later changes may be treated as revisions and billed accordingly. For example:
-
head base shape,
-
markings placement,
-
eye design,
-
fur colors,
-
mochi minky colors,
-
teeth size, amount, & placement,
-
tongue size & placement,
-
eyeliner/eyelash style,
-
hair changes/styling
-
body shape (for padded bodysuits),
-
any step that may require sublimation or special machinery
-
-
-
Revisions and Change Requests
-
Included revisions. Revisions are considered to be changes asked after approval. The commission includes three (3) minor revisions. Examples:
-
marking changes,
-
shape changes,
-
eye changes,
-
hair changes/styling,
-
small details
-
-
Major revisions/changes. Anything that changes the scope (new features, new character, major redesign, size changes, or color changes after build starts) may require:
-
Additional fees, and
-
Timeline extension, and/or
-
A new quote
-
-
After approval.Changes requested after you approve a stage may be billed as rework.
-
-
Shipping, Delivery, and Risk of Loss
-
Shipping address. You are responsible for providing a complete and correct shipping address. Address changes after shipment may incur fees or be impossible depending on the carrier.
-
Shipping method. We ship via USPS, UPS, FEDEX or DHL, with:
-
Tracking: Included
-
Insurance: Included
-
Signature: Optional
-
-
International orders (if applicable). You are responsible for customs fees, VAT, duties, import taxes, and any brokerage charges.
-
Damage in transit. If your package arrives damaged:
-
Keep all packaging,
-
Take photos of the box and item immediately, and
-
Notify us within 48 hours of delivery so we can assist with claims.
-

Lost packages. If a package is lost, we will work with the carrier. Refunds/replacement depend on the carrier’s claim outcome and whether insurance was purchased/included
-

Handmade and Custom Nature; No Perfect Uniformity. Client understands and agrees that each fursuit is a custom-made, handmade, artistic product, not a mass-produced item. As a result, the final product may contain minor imperfections, asymmetry, and cosmetic variations, and is not guaranteed to be perfectly uniform or identical to reference images, digital mockups, or prior work. Acceptable variations may include (without limitation) minor differences in fur directions or shading, trimming length, stitch visibility, seam placement, marking alignment, foam shaping or any other minor imperfection visible upon close inspection. These characteristics are considered normal and expected in handmade work and do not constitute defects and are not grounds for refunds, chargebacks, or free remakes.

Refunds, Cancellations, and Returns (Custom Goods Policy)

No returns for change-of-mind. Because commissions are custom-made, we do not accept returns or refunds for: buyer’s remorse, aesthetic preferences, or changes in personal circumstances ( Personal relationship issues, Money or Job loss, etc.).

If the Client cancels:
-
Deposits are non-refundable.
-
Any work completed and any non-recoverable costs (materials, outsourced parts) are deducted from any potential refund.
-
If the remaining balance is unpaid, you remain responsible for completed work/costs up to the cancellation date where permitted by law
-
-
If we cancel: If we must cancel for reasons on our side, we will refund amounts paid minus non-recoverable costs already spent on your behalf unless we choose to refund in full.
-
Defects vs wear. Refunds are not the default remedy for defects. We typically offer repair/remake per our Warranty, Repairs and Care section.
-
Chargeback fees. If you initiate a chargeback and we win the dispute, you agree to reimburse any fees/costs we incur to the extent permitted.

Warranty, Repairs, and Care
-
Limited workmanship warranty. We offer a 90-day limited warranty from delivery covering workmanship defects under normal use.
-
Not covered. The warranty does not cover:
-
Normal wear and tear,
-
Damage from falls,rough handling, pets, smoke, heat, water, improper cleaning, or modifications by anyone other than us,
-
Stains, matting, or shedding consistent with normal use of faux fur.
-
-
Repair process. Contact us with photos and a description. If covered, we will repair or replace at our discretion. Clients may be responsible for shipping costs depending on fault and location.
-
Care instructions. You agree to follow the care instructions we provide. Failure to do so may void warranty coverage.
-
Voiding the Warranty. The limited workmanship warranty may be voided if any third party alterations or modifications are made to the fursuit. If applicable, the nature of the modifications will be reviewed on a case by case basis to honor or void the warranty depending on the severity of the damage at Battitude LLC discretion.

Abandoned / Inactive Commissions
-
Non-responsiveness. If you do not respond to messages, emails, correspondence or calls; requesting required info or approvals for 30 days, your commission may be considered inactive and paused
-
Abandoned status. If there is no response within 90 days from when the commission is set to inactive, the commission may be considered abandoned.

Disposition. After 30 days abandoned, we may at our discretion (where permitted):
-
Cancel the commission,
-
Keep the deposit,
-
Invoice for completed work/costs, and/or
-
Repurpose or sell non-identifiable components (never selling identifying art of the character — see Photos, Portfolio Use, and Intellectual Property)
-
-
Response after inactivity/abandonment. Depending on the amount of time the commission was either inactive or abandoned, a fee will be incurred to resume work.
-
If the commission was more than 30 days inactive, a fee of 10% of the commissions original cost will be incurred
-
If the commission was more than 30 days abandoned, a fee of 25% of the commission's original cost plus the previous inactive fee will be added.

Photos, Portfolio Use, and Intellectual Property
-
Portfolio permission. Unless you opt out in writing, you grant us permission to photograph and share the finished work-in-progress and final product for portfolio/marketing (website, social media, etc.)

Opt-out. You may opt out or request limited posting (example: no WIP, only final reveal, or delay posting until after a certain date).
-
IP ownership.
-
You retain rights to your character/design.
-
We retain rights to our original patterns, techniques, base sculpts, and templates.
-
-
No commercial reproduction. You may not reproduce our patterns or create commercial copies based on our work without written permission.
-

Pricing, Taxes, and Miscellaneous Fees
-
Sales tax. Sales tax is charged where required by law based on shipping destination and applicable nexus rules.
-
Material substitutions. If a material becomes unavailable, we may propose a comparable substitute. If you insist on specific rare materials, costs may increase.
-
Communication channels. Official approvals and commitments must be in writing via email.
-

Assumption of Risk
Wearing and using a fursuit involves inherent risks, including but not limited to overheating, dehydration, reduced vision and hearing, reduced mobility, tripping/falling, collisions with objects or people, and allergic reactions to materials. Client acknowledges and voluntarily assumes responsibility for all risks associated with wearing, handling, transporting, or performing in the suit.
The fursuit is a costume/prop for entertainment purposes only and is not safety equipment or protective gear. It is not designed or certified to protect against impacts, falls, environmental hazards, fire/heat, chemicals, or medical conditions.
Battitude LLC does not provide medical advice. Client is responsible for determining whether they are physically able to wear a fursuit safely. If the client has any health condition, they should consult a qualified professional before use.

Limitation of Liability
To the fullest extent permitted by law, Battitude LLC [DBA, Battitude Studio] is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim will not exceed the amount you paid for the commission.

Force Majeure
We are not responsible for delays or failure to perform due to events outside of our control, including supplier delays, carrier disruptions, natural disasters, illness, or internet/power outages.

Governing Law and Disputes
These Terms are governed by the laws of California, USA. Disputes will be resolved in San Diego County, California, and you agree to attempt a good-faith resolution first by contacting us at fursuits@battitudestudio.com.

Changes to These Terms
We may update these Terms from time to time. The version in effect at the time you paid your deposit applies to your commission unless both parties agree otherwise in writing.
